Resale License (Standard): Terms & License

This is a non-exclusive, non-transferable license agreement between you and Ginny Culp.

A personal use license agreement must accompany all music tracks that you sell. A current copy of this license is available by clicking here.

By ordering and using this Royalty-Free Music you agree to be bound by the following terms and conditions:

The music in this collection is proprietary and copyrighted. This copyright is protected under U.S. and International copyright law. Ginny Culp grants special permission and reserves all rights, except for those specifically granted by the license agreement below.

RESALE (STANDARD) LICENSE AGREEMENT

The sounds, samples, music tracks and loops in this collection are licensed to you, not sold to you.

All rights not expressly granted to the user are reserved. Only the original purchaser of this collection has a legal right to sell these sounds, samples music tracks and loops.

This is a non-exclusive, non-transferable license agreement between you and Ginny (Virginia) Culp. Please read this agreement carefully before using the product. If you choose not to accept this agreement, you must return the product unused. By using any part of the Data, you are agreeing to the following terms:

All copying, lending, duplicating, re-selling, renting, uploading, file sharing or Unauthorized trading of this content (or any part of this content) is prohibited by international copyright law. We will not hesitate to take legal action against any person or company that fail to adhere to the terms of this agreement.

All music contains a copyright which is included as both a copyright license file, and also embedded as meta tags into
the MP3 files. These copyright notices cannot be removed.

Tracks cannot be edited or changed (this includes the name of the track or the name of the file).

In short, your customers/subscribers will be acquiring personal use rights (resell rights cannot be passed.)

Pricing guidelines: Music collections should not be devalued by selling on sites such as EBay. Most collections should retail for a minimum of 17.00 (larger ones for a higher price).

[YES] You may request a sub-license for your business partner or video producer who is creating a video production for YOU
[YES] You can sell videos and audios that contain these music tracks as background music or effects
[YES] You can store these music files on an FTP server
[YES] You can sell the music (a personal use license)
[NO] You can repackage the audios with another product of similar or greater value
[NO] You can offer the audios as a bonus to a paid product of similar or greater value (your product)
[NO] You can include the music to a paid membership site
[NO] You can rebrand the music "private labeled"
[NO] You can sell the resale rights
[NO] You can include the audios to a free membership site
[NO] You can give away the music
[NO] You can sell the audios in auction sites
[NO] You can edit the audios, isolate sounds or loops to create new "remixes" or "loops" for the purpose of resale.
[NO] You can convert the file to another digital file format prior to selling
[NO] You can split the package into smaller "mini" packages
[NO] You can convert MP3's into other digital music formats (such as WAV format or AIFF format) for the purpose of resale.
[NO] You can retitle the song
[NO] You can claim copyright.
[NO] You can remove the meta data from the MP3's (such as copyright notice) prior to selling
[NO] You can also download and sell high resolution audio tracks such as WAVS or AIFFS
[NO] You can edit the music for the purpose of creating a preview of the track for online use - i.e. make a sample file (they are already provided to resellers)
[NO] You can create a combo pack of more than two music collections from Ginny Culp
[YES] You can sell online as a digital download
[NO] You can sell online as a physical product (such as DVD or CD)

YOUR PERSONAL USE:

In the production of your own digital creations (audio and video) you may also use these sounds, samples music tracks and loops. You must agree to the PERSONAL USE LICENSE.

PRODUCTION STUDIO EXPANDED USE:

In the production of your own digital creations (audio and video) you are also entitled to the backward compatible PRODUCTION STUDIO EXPANDED USE. This license allows you to apply for a personal use license for your business partners, JV partners, or freelancers who are creating a video for YOU.

TELEVISION BROADCAST:

If your production is scheduled for TV broadcast a cue sheet must be completed and submitted to the broadcaster. The track title, composer and duration must be listed. Royalties from public broadcast are paid by the broadcaster to the performance rights society. You are responsible for filing only.
